Terms of service

The rules for using this site, and the baseline terms for working together. If you have signed a proposal or agreement with me, that document wins wherever the two disagree.

Who are these terms with?

MMEC, short for Market My Entertainment Centre, is operated by Travis Kelly out of Sarnia, Ontario. In this document, "I" and "me" mean MMEC, and "you" means the person or business using this site or engaging me for work.

The business operates as Market My Entertainment Centre, 1-1886 London Line, Sarnia, Ontario N7W 1B3, Canada. Notices under these terms can go to that address or to travis@marketmyec.com.

Accepting them

Using this site means you accept these terms. If you do not, please do not use it. Engaging me for work means you accept these terms together with whatever we sign, and the signed document takes priority wherever the two disagree.

What this site is

A description of what I do, my published pricing, and writing about marketing for entertainment venues. It is not professional, legal, financial, or accounting advice, and reading it does not make you a client.

What is the free scan, and what is it not?

The scan is a best-effort snapshot of what is publicly visible about your venue at the moment I run it. It is not an audit, it carries no guarantee of completeness or accuracy, and it puts no obligation on either of us.

Platforms change constantly. A finding that was true the day I looked can be wrong a month later.

Where a signed agreement fits

If you and I sign a proposal or statement of work, that document governs the engagement. These terms fill the gaps it does not address. Where they conflict, the signed document wins.

Fees and payment

Prices are in Canadian dollars and published on the pricing page. The Foundation is a one-time fee. Full Calendar is a monthly fee. Quoted prices exclude applicable taxes, including HST.

Advertising spend is paid by you directly to Google and Meta, not routed through me, unless the signed agreement says otherwise. The monthly fee does not include it.

The Foundation is invoiced half when you sign and half on launch. Full Calendar is invoiced monthly in advance, starting the month after launch. Invoices are due within 15 days. If an invoice is more than 30 days overdue, I may pause work until it is paid.

One client per category per market

I take one client per venue category per market. If I am running paid ads for a trampoline park in a given city, I will not take on a second trampoline park in that city while the engagement is live.

The category, the market, and the length of the commitment are defined in the signed agreement, because those words need to mean something specific to be worth anything. It does not stop me working with a different category in the same city, or the same category in a different market.

What I need from you

  • Timely access to the accounts and platforms the work depends on.
  • Accurate information about your venue, your pricing, and your capacity.
  • One named person who can approve work and make decisions.
  • The legal right to use any copy, photos, or logos you hand me.

Delays on your side move the schedule. I will tell you when that happens rather than quietly absorbing it.

Who owns what?

The content of this site, including its text, layout, code, and marks, belongs to MMEC.

Deliverables produced specifically for you, including a website I build for your venue, transfer to you once you have paid for them in full. Websites are built in WordPress, and once paid for, the site and its content are yours to keep, move, or hand to someone else. Until payment is complete, deliverables remain mine.

I keep ownership of my own tools, templates, processes, and know-how, including anything developed before or outside your engagement, and I remain free to reuse them. Third-party assets such as fonts, stock imagery, and plugins carry their own licences, which pass to you exactly as they are.

Showing the work

I may describe work in general terms as part of a portfolio. Naming your venue, using your logo, or publishing your numbers requires your written permission first.

Third-party platforms

The work runs on platforms I do not own: Google, Meta, WordPress and its plugins, your web host, your booking system, and your email provider. They write their own rules, change them without notice, and can suspend an account with little explanation.

I will work within those rules and tell you when one changes something that matters. I am not responsible for their decisions, outages, policy changes, or price increases.

Do I guarantee results?

No. Read this one properly, because it is the clause most likely to matter.

What happens after a marketing campaign goes live depends on your pricing, your staffing, your capacity, your reviews, the season, your competitors, and how the platforms behave that month. Most of that is outside my control and some of it is outside yours.

I commit to doing the work described in the agreement, competently and on schedule. I do not commit to a number of bookings, a ranking position, a cost per acquisition, or a revenue figure. Any figure discussed before or during the work is an estimate and an argument, not a promise.

Limits on liability

To the fullest extent Ontario law permits, I am not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost goodwill.

My total liability for any claim connected to the work is capped at the fees you actually paid me in the 12 months before the claim arose.

Nothing here limits liability that the law does not allow to be limited.

Indemnity

You agree to cover me against claims arising from content you supplied, from your use of deliverables after handover, or from your breach of a third-party platform's terms.

How does an engagement end?

Either of us may end an ongoing engagement on 30 days' written notice. You pay for work completed up to that date. Fixed-scope projects end according to the signed agreement.

On termination I hand back access to your platforms and return or delete your material, and the one-client-per-category commitment ends with the engagement.

Confidentiality

This runs both ways. Non-public information either of us learns about the other stays private and gets used only for the engagement. That obligation outlives the engagement.

Privacy

How I handle personal information, including what you send through the forms on this site, is set out separately in the privacy policy.

Changes to these terms

Revised terms go up here with a new date at the top. A change that materially affects an active engagement will be sent to you directly rather than quietly posted.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction.

Severability and entire agreement

If a clause turns out to be unenforceable, it gets severed and the rest stands. These terms, together with any agreement we have signed, are the entire understanding between us and replace anything discussed beforehand.
